Defence when a drug discovery is attributed to you

Drugs found – but who is legally in possession

A possession allegation can arise before the legal attribution is clear. Drugs may be found in an apartment, vehicle, bag or during a police stop – but possession under German law requires more than proximity. The key issues are actual access, knowledge, intent to control and whether a specific quantity can safely be attributed to the suspect.

Checklist

  • Do not comment on origin, quantity, purpose or ownership before the case file has been reviewed.
  • After a search, keep the search warrant, seizure list and details of where the substance was found.
  • Do not rush into saying that the drugs were “only for personal use” if quantity, packaging or messages may be interpreted differently.
  • In shared premises, clarify who had keys, access and actual use of the area where the substance was found.
  • In vehicle stops, distinguish driver, passenger, registered owner, someone else’s bag and mere presence in the car.

Possession means actual control – not ownership

A German drug possession case often starts with a discovery. Legally, the discovery alone is not enough. Possession means actual control: the suspect must have had the ability to access and dispose of the substance. The intent to maintain that control must also be proven.

Ownership is not decisive. A person can possess drugs owned by someone else if they knowingly keep them or have access to them. Conversely, mere proximity does not automatically amount to possession. Being present in an apartment, travelling in a vehicle or knowing about another person’s drugs is not enough by itself.

Typical scenarios in possession cases

In shared apartments, the central issue is often whether the substance can be attributed to a specific person. Drugs found in a kitchen, bathroom, hallway, basement, living room or shared drawer are not automatically possessed by every resident. Keys, personal items, traces, actual use of the space and the precise location of the discovery may matter. A discovery in a private bedside table is different from a discovery in an open area of a shared flat.

In vehicle stops, the location of the substance and actual access are central. Drugs found in the client’s jacket, another person’s backpack, the glove compartment, under the passenger seat or in the trunk may raise different questions. Driver, owner and passenger cannot simply be treated the same. Mere presence in a vehicle where drugs are found does not replace proof of actual control.

In street-level police stops, possession allegations often arise after a small quantity is allegedly dropped, thrown away or found nearby. The decisive questions may be whether the substance can be reliably attributed to the client, whether witnesses or video evidence exist and whether the quantity was usable for consumption at all. Residues, drug paraphernalia or a positive drug test do not by themselves prove possession of a specific substance.

Personal use does not automatically resolve the case

Drug consumption itself is generally not punishable under German law. Possession before consumption, however, may be. For that reason, saying that the drugs were for personal use does not always resolve the allegation.

At the same time, possession should not be too quickly treated as trafficking. Packaging, cash, scales, messages or larger quantities may raise suspicion of supply or sale. But they must fit the actual possession situation. Stockpiling, joint acquisition or storing drugs for someone else is not automatically profit-oriented drug turnover.

Before stating that “it was all for me”, the file should be checked for whether quantity, financing, packaging and communications support that explanation — or undermine it.

Small quantity, personal use or a more serious possession allegation

In smaller personal-use cases, dismissal under section 31a of the German Narcotics Act or dispensing with punishment under section 29(5) may be possible. This does not depend on weight alone. Substance, personal-use context, prior records, place of discovery and indications of supply may all matter.

With larger quantities, the allegation may become significantly more serious, especially if a significant quantity is alleged. In that situation, active ingredient content is usually decisive — not merely gross weight. The calculation is one of the first points that should be checked in the case file.

Even apparently minor discoveries require careful review. It may matter whether the allegation is based only on a field test, whether a chemical analysis was performed, whether packaging material was included in the weight or whether the substance was reliably identified as a controlled substance at all.
