What does it mean for your residence status?
A fiction permit does not automatically mean that you may continue travelling, working or re-entering Germany under the same conditions as before. What matters is not the document itself, but which legal fiction under §81 Residence Act applies in the individual case. What is a fiction permit?
Many applicants receive a fiction permit after filing an application for a residence permit or extension and assume that all previous rights automatically continue unchanged. In practice, this assumption is often incorrect.
A fiction permit generally does not constitute an independent residence permit. Instead, it confirms that a statutory legal fiction under §81 German Residence Act may apply. Actual rights depend primarily on the specific type of legal fiction and the applicant’s immigration situation.
Differences between these forms of legal fiction may have substantial practical consequences. They can affect lawful residence, employment authorization, international travel, future extensions or eligibility for permanent residence.
Practical problems often arise because similar-looking permits may reflect fundamentally different legal situations. For legal assessment, the underlying statutory provision and the timing of the application are frequently more important than the document itself.
Which types of legal fiction exist?
German immigration law distinguishes between several forms of legal fiction. Although they are often collectively referred to as “fiction permits”, the legal consequences differ substantially.
Continuation fiction (§81 para. 4 Residence Act)
Continuation fiction generally provides the strongest level of protection. It usually applies where an existing residence permit is renewed or replaced through a timely application submitted before expiry.
The previous residence permit generally continues until the immigration authority issues a decision. Existing employment authorization may also continue. However, whether all previous rights remain unchanged should still be assessed individually.
Continuation fiction is particularly relevant for extensions of residence permits, EU Blue Cards and family reunification permits.
Permission fiction (§81 para. 3 sentence 1 Residence Act)
Permission fiction often affects individuals who lawfully stay in Germany and apply for a residence permit for the first time.
Residence generally remains lawful while the application is pending. However, this does not automatically grant all rights associated with a residence permit, especially regarding employment authorization or international travel.
Misunderstandings frequently arise because applicants assume a broader legal status than actually exists.
Toleration fiction (§81 para. 3 sentence 2 Residence Act)
If a required application is filed too late, only a toleration fiction may arise.
This generally creates a significantly weaker legal position. It does not automatically establish lawful residence and provides considerably less protection than continuation fiction.
Late applications may therefore affect future immigration procedures and long-term residence prospects.
Travelling with a fiction permit
Travel questions are among the most common practical issues involving fiction permits. Many applicants assume that holding a valid document automatically permits departure from and re-entry into Germany. This assumption may create serious problems.
Whether travel is possible often depends on several factors:
- the applicable legal fiction
- whether a previous residence permit continues
- wording and entries on the permit
- destination country
- route and point of re-entry into the Schengen Area
Incorrect assumptions may have substantial consequences. In individual cases, re-entry into Germany may become difficult or impossible.
