When a person is arrested in Germany on a foreign request, the German authorities and courts first deal with detention and then with the legal permissibility of surrender. The allegation in the requesting state is not normally retried. The German proceedings concern the requirements for surrender and any legal obstacles to extradition.
After an arrest, the first task is usually to establish which request is being enforced and the legal basis for continued detention. Objections to extradition may already matter at this stage. If surrender has been declared permissible, we examine the remaining remedies and, where time is short, urgent constitutional relief.
We conduct extradition proceedings throughout Germany. Meetings can take place in Berlin, Düsseldorf or by video conference. Where the underlying case abroad also requires representation, we involve suitable local counsel.
