Criminal Defence

RATH HAGEN defends suspects and defendants in criminal proceedings throughout Germany. We act during investigations, after indictment and at trial, as well as in appeal proceedings.

A police summons is rarely a reason to make an immediate statement. We usually obtain the investigation file first and decide how to proceed once the evidence is known. If a search is under way or a client has been arrested, we can take over the defence at short notice. Where an arrest warrant exists, we examine its basis and the available means of avoiding or ending pre-trial detention.

Our work has a particular focus on drug, homicide and sexual-offence cases as well as criminal immigration law. Meetings are available in Berlin and Düsseldorf or by video conference.

Defence in drug proceedings, including cases involving significant quantities and extensive digital evidence.

Summons, Search, Arrest and Indictment

Decisions made at an early stage can materially affect the course of a criminal case. Before making a statement, during a search or following an arrest, the appropriate response depends on the procedural stage.

Police Summons Received
The investigation file should normally be reviewed before any statement is made. We take over communications with the police and request access to the file.
Penalty Order Received
A German penalty order can be challenged within two weeks. We review the allegation and sentence and advise on the scope of an objection.
Indictment Received
Service of the indictment opens the intermediate proceedings. At this stage, the defence considers whether and how the indictment should be challenged before trial.
Search and Seizure
Immediate legal assistance can be useful while a search is in progress. We then review the search warrant and any items seized.
Arrest and Pre-Trial Detention
Following an arrest, the arrest warrant becomes the immediate focus. We prepare for the detention hearing and examine how pre-trial detention can be avoided or brought to an end.
Access to the Investigation File
The investigation file usually provides the basis for defence decisions. We obtain it and assess the material with the client.

Investigation and Trial

Once the investigation file is available, the case can be assessed on its actual evidence. The decision whether to make a statement, file applications or contest the case at trial depends on that record.

Defence During the Investigation
During the investigation we analyse the file and deal with police and prosecutors. In many cases, this stage determines whether charges will be brought at all.
Defence at Trial
At trial we conduct the defence during the evidential hearing, question witnesses and make the necessary applications.
Trial Defence Strategies
The appropriate form of defence varies from case to case. It depends on the evidence, the objective of the proceedings and the actual risk of conviction.
The Deal in German Criminal Proceedings
A proposed plea agreement must be assessed against the evidence and its consequences for sentence and appeal.
