As an appellate court, the Regional Court reconsiders judgments from the five Local Courts in the district on both the facts and the law. The defense may therefore present new evidence and request that witnesses be heard again.

Düsseldorf Higher Regional Court

The Mönchengladbach Regional Court district forms part of the Düsseldorf Higher Regional Court district. The Higher Regional Court decides appeals on points of law from Regional Court appellate judgments and direct appeals on points of law from Local Court judgments. It may also hear particularly serious national-security prosecutions at first instance.

After an arrest, the first question is whether the person is being held temporarily or under a judicial arrest warrant. Placement after a final conviction is governed by a separate enforcement plan. Relevant factors include the length and nature of the sentence, prior custody status, and eligibility for an open facility.

Family members should have the detained person’s full name and date of birth available when contacting the authorities. A case number will make identification easier. The actual place of detention must be established before a visit is arranged. A judicial visitation permit may also be required in a pretrial-detention case. Visiting hours and organizational requirements differ between the main facility in Willich and the Mönchengladbach branch and should be checked directly with the responsible facility.
