INTERPOL Alerts and Their Consequences
RATH HAGEN acts for clients worldwide in INTERPOL matters. A central part of the practice is proceedings before the Commission for the Control of INTERPOL’s Files (CCF), particularly cases involving Red Notices and Diffusions. We also advise on the practical consequences of international alerts, including travel, arrest and extradition risk.
Before taking action against an INTERPOL alert, we establish what is actually in place and what the alert is based on. A request to the CCF is not always the first step. In some cases, the national arrest warrant must be challenged or extradition proceedings defended first. Several proceedings may need to be handled in parallel and coordinated with each other.
Dr Julius Hagen represents clients before the CCF in Red Notice and Diffusion matters. In cross-border cases, he works with local counsel where required and coordinates the proceedings. INTERPOL Proceedings and Remedies
The CCF can be asked to provide access to data held by INTERPOL. Where the processing of that data is inconsistent with INTERPOL's rules, correction, restriction or deletion may be available.
Alert, Travel and Arrest
An international alert can have consequences before any arrest—at border controls, during travel or as soon as indications of a Red Notice or Diffusion emerge.
INTERPOL, Criminal Proceedings and Extradition
A Red Notice can lead to arrest and extradition proceedings. Any challenge to the alert must therefore also take account of the underlying criminal proceedings and the possibility of extradition.
